These General Terms & Conditions apply to workshops, cultural events, classes and other in-person events organised by Biyori (“we”, “us”, “the organiser”).
By booking an event, the participant agrees to these terms.
1. Booking and Contract
A booking becomes binding once the participant receives a booking confirmation from Biyori.
The event description published at the time of booking, including the date, location, programme and participation fee, forms part of the agreement.
Places are limited and are allocated according to availability.
2. Participation Fee and Payment
The participation fee stated on the event page is the total price for the event and includes the materials and services specifically mentioned in the event description.
Payment must be made using one of the payment methods offered during booking or within the payment period stated in the confirmation.
If payment is not received within the stated period, Biyori may release the reserved place after notifying the participant.
3. Cancellation by the Participant
Participants may cancel their booking free of charge up to 48 hours before the scheduled start of the event.
For cancellations made less than 48 hours before the event, the participation fee is non-refundable.
If a participant cannot attend, the booking may be transferred to another person at no additional charge. Please inform Biyori of the replacement participant’s name before the event.
If a participant does not attend the event without cancelling in advance, the participation fee will not be refunded.
Any statutory rights of the participant remain unaffected.
4. Right of Withdrawal
Bookings for leisure activities, workshops and events that take place on a specific date or during a specific period are generally excluded from the statutory 14-day right of withdrawal under German law.
The cancellation option described above is therefore a voluntary cancellation policy offered by Biyori.
5. Cancellation or Changes by Biyori
Biyori reserves the right to cancel an event if it cannot reasonably take place, for example because of illness, insufficient participant numbers, problems with the venue or circumstances outside our reasonable control.
If Biyori cancels an event, participants will receive a refund of the participation fee already paid.
Where reasonably necessary, Biyori may make minor changes to the programme, timing, instructor, materials or venue, provided that the overall character and value of the event remain substantially unchanged.
If a material change makes participation unreasonable for the participant, the participant may request cancellation and a refund of the participation fee.
Biyori is not responsible for additional expenses incurred by participants, such as travel or accommodation costs, unless liability arises under mandatory law.
6. Late Arrival
Participants are asked to arrive on time.
If a participant arrives late, we will try to include them in the remaining programme where reasonably possible. However, individual parts of the workshop may not be repeated, and no partial refund will be provided for parts missed because of late arrival.
7. Food, Allergies and Dietary Requirements
Some Biyori events include food, wagashi, matcha or other edible products.
Participants are responsible for informing Biyori of relevant allergies or dietary requirements before the event.
We will make reasonable efforts to accommodate notified requirements where possible, but we cannot guarantee that an event environment or food preparation area is completely free from traces of allergens.
Participants with severe allergies should contact Biyori before booking so that we can clarify whether participation is suitable.
8. Materials and Handmade Results
Workshop results may vary depending on the participant’s experience, technique and the natural characteristics of the materials used.
Small differences in colour, shape, texture or appearance are a normal part of handmade work and do not constitute a defect.
Unless stated otherwise, participants may take home the items specifically identified as take-home materials in the event description.
9. Conduct and Safety
Participants must follow reasonable instructions given by the organiser or instructor, particularly where equipment, food preparation, tools or other materials are involved.
Participants must treat the venue, equipment, other participants and instructors with consideration.
Biyori may exclude a participant from an event where their behaviour creates a significant safety risk, seriously disrupts the event or unreasonably affects other participants.
10. Photography and Video
Biyori may occasionally photograph or film its events for documentation or promotional purposes.
Where identifiable participants are to be photographed or filmed for promotional purposes, they will be informed and consent will be requested where required.
Choosing not to consent to promotional photography does not affect the right to participate in the event.
11. Intellectual Property
Workshop materials, handouts, teaching content, photographs, designs and other materials provided by Biyori or guest instructors remain protected by applicable intellectual property laws.
Participants may use materials provided during the workshop for their own private purposes unless otherwise stated.
Commercial reproduction, publication, teaching or distribution of workshop materials is not permitted without prior permission from the respective rights holder.
12. Liability
Biyori is liable without limitation where liability is mandatory by law, including for damage resulting from injury to life, body or health caused by negligence, and for damage caused intentionally or through gross negligence.
For other damage caused by simple negligence, liability is limited, where legally permissible, to breaches of essential contractual obligations and to the foreseeable damage typical for the contract.
Participants remain responsible for their personal belongings unless loss or damage is attributable to Biyori under applicable law.
13. Force Majeure and Circumstances Beyond Our Control
If an event cannot take place because of circumstances outside the reasonable control of Biyori, such as severe weather, official restrictions, disruption of the venue or comparable circumstances, participants will be informed as soon as reasonably possible.
Where possible, Biyori may offer a replacement date, credit or refund depending on the circumstances and applicable law.
14. Data Protection
Personal data provided in connection with a booking will be processed for the administration and performance of the event and in accordance with Biyori’s Privacy Policy.
Marketing communications will only be sent where there is an appropriate legal basis or consent.
15. Applicable Law
German law applies.
For consumers who have their habitual residence outside Germany, mandatory consumer-protection rules of their country of residence remain unaffected where applicable.
The statutory rules regarding jurisdiction apply.
16. Consumer Dispute Resolution
Biyori is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
